ConCourt Orders Mwanakatwe to Re-File Appeal Within 14 days
Finance minister Margaret Mwanakatwe is hanging by the thread after the court ordered that she files her appeal papers properly within 14 days.
Mwanakatwe’s Lusaka Central seat has been a subject court interest after it was nullified by the Lusaka High Court over electoral malpractices.
Losing UPND candidate Charlotte Scott petitioned her loss successfully but Mwanakatwe has appealed in the Constitutional Court.
Judge Anne Sitali threw out Scott’s application to quash the stay granted to Mwanakatwe on the decision to declare her seat vacant.
The Consitutional Court guided that the nullification by the High Court cannot be confirmed until the Constitutional Court had made its ruling.
Justice Sitali ordered that Mwanakatwe files her appeal properly within 14 days or risk having her nullification.
“Following an appeal by the defendant, by operation of law, the decision of the lower court is stayed,” stated Justice Sitali.
