ConCourt Upholds Election of UPND Candidate Chinga Miyutu
The Constitutional Court has upheld the election of UPND Kalabo Central MP Chinga Miyutu. His opposition, Patriotic Front candidate Richard Mwapela had failed an appeal that the result be dismissed.
The court found that Mwapela’s claims that Miyutu bribed voters with salt were baseless.
Justice Anne Sitali ruled that the allegations of electoral violence did affect the voters’ turn out, pursuant to section 97 (2) of the Electoral Act.
She however noted that the evidence adduced was not enough to overturn the outcome of the election.
“All in all, the appellant has not proved all the allegations and all the grounds of appeal are dismissed, the appeal fails in its entirety,” she said.
